The 1% TDS, and whose filing it actually is

You pay the same 1% TDS a resident buyer pays, under Section 194-IA, where the consideration is Rs 50 lakh or more, because the rule looks at the seller's residential status and not yours, and ACE Infracity Developers Pvt. Ltd. is a resident company. On the 3 BHK's base price of Rs 3,27,49,365* (the figure ACE's own film publishes as Rs 3.27 Crore*), on the 4 BHK and on the 4 BHK + servant, the desk works the 1% out for you on a dated cost sheet, deducted across the instalments of the 20X5 plan rather than in one payment.

Form 26QB is your own filing. The law puts the deduction and the filing on the buyer, resident or NRI, for each instalment, not on the developer and not on the desk. What the desk actually does is walk you through each Form 26QB as the instalment falls due, with the exact figure already worked out against that instalment, so the filing itself is the only part left in your hands.

When Section 195 and Form 27Q would apply, and when they do not

Not at this purchase. Section 195 and Form 27Q govern TDS on a sale by an NRI, so they belong to the day you might sell an ACE Arte unit, not the day you buy one from the developer. Buying from ACE Infracity Developers Pvt. Ltd. today puts you inside Section 194-IA and Form 26QB only. Buying without flying to Noida
